Wayne County Marriage License

Marriage licenses are handled by the Wayne County Prothonotary and Clerk of Orphans' Court at 925 Court Street, Honesdale, PA 18431. The county's Marriage Licenses page says Pennsylvania law requires a three-day waiting period after applicants appear in the Marriage License Bureau. Application must be made within 60 days of the wedding date, and the issued license is valid for 60 days. The license may be used anywhere in Pennsylvania.

Applicants must be 18 or older. Pennsylvania no longer permits under-18 marriage license applicants. Wayne County also says both parties must appear in person, and the office does not issue marriage licenses to prison inmates because it is not equipped with video-conference technology. Appointment calls go to 570-253-5970 ext. 1220 or ext. 1205. Appointments are Monday through Friday, 8:30 a.m. to 3:30 p.m.

Wayne County Marriage Limits

Wayne County includes two local warnings that matter before a ceremony. The county says it will not decide what is or is not a church or congregation for internet-ordained officiants. It warns that internet-ordained persons may not qualify as ministers under Pennsylvania marriage law if they do not regularly preach to a congregation that meets at a place of worship. The county also notes that common law marriage is no longer valid in Pennsylvania effective January 1, 2006.

The Prothonotary maintains civil actions, domestic-relations cases such as divorce actions, PFAs, support and custody, judgments, liens, equity actions, and eminent domain proceedings. Searchers should bring names, approximate dates, docket numbers if known, and enough detail to inspect the index or request copies.

Pennsylvania divorce residency is governed by 23 Pa.C.S. 3104. At least one party must have been a bona fide Pennsylvania resident for at least six months before filing. Wayne County's Court Policies page says a party may seek appointment of a Hearing Officer by petition after filing a divorce action, depositing $500 with the Prothonotary for Hearing Officer fees and $200 with the attorney escrow account for transcripts to court reporters. More funds may be required if exhausted.
